Personal data linked to the website and electronic headquarters under the responsibility of the FUENGIROLA CITY COUNCIL comply with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD).

The FUENGIROLA CITY COUNCIL is responsible for maintaining a record of processing activities under its responsibility in compliance with the obligations established in Article 30 of the GDPR.

For what purpose do we process your personal data?

The FUENGIROLA CITY COUNCIL will process the personal data of interested parties, generally, to:

  • Manage the different administrative procedures and provide information about their processing.
  • Verify or check the accuracy of personal data that interested parties claim are already in the possession of public administrations or that were previously submitted.
  • Send notifications and process appeals.
  • Handle requests for information, suggestions, general communications, and send newsletters.

What is the legal basis for processing your data?

The FUENGIROLA CITY COUNCIL is authorized to process personal data in accordance with the principle of lawfulness of processing as stated in Article 6 of the GDPR, specifically:

  • Generally, in the case of administrative procedure activities, the legal basis for processing will be the fulfillment of a task in the public interest or the exercise of public authority, taking into account Law 39/2015, of October 1, on Common Administrative Procedure; Law 9/2017, of November 8, on Public Sector Contracts; Law 39/2015, of October 1, on Common Administrative Procedure, etc.
  • In certain cases, processing will be legitimized by the consent of the interested parties.
  • In any case, the basis for legitimacy will be included in the basic informative clauses available in personal data collection forms.

To whom will your data be disclosed?

Your data may be disclosed, in accordance with current legislation and whenever necessary for the management of the procedure or request, to other public administrations in the exercise of their powers, to financial entities, to official journals, websites, or notice boards of the FUENGIROLA CITY COUNCIL to provide the legally required publicity in the procedures where necessary.

How long will we keep your personal data?

The personal data provided will be retained unless you request their deletion or cancellation and as long as they remain adequate, relevant, and limited to what is necessary for the purposes for which they are processed.

Will you have the possibility to withdraw your consent?

You will have the possibility and the right to withdraw your consent for any specific purpose granted at the time, without affecting the lawfulness of the processing based on the consent given before its withdrawal.

Where can you exercise your rights?

The interested party may exercise their rights free of charge, receiving a response within the deadlines established in the GDPR and the LOPDGDD, through the following means:

  • In writing at the registry of the FUENGIROLA CITY COUNCIL. This request must be signed and accompanied by a copy of the applicant’s ID card or passport. If acting through a legal representative, the representative must also provide their ID and the document accrediting their representation.
  • If the FUENGIROLA CITY COUNCIL has reasonable doubts regarding the identity of the individual making the request, it may request additional information necessary to confirm the applicant’s identity.
  • The FUENGIROLA CITY COUNCIL must respond to the request within one month of receipt. This period may be extended up to two months, considering the complexity and number of requests received. The applicant will be informed within one month from the receipt of the request.

What are the security measures?

In compliance with Article 32 of the GDPR and considering the provisions of the First Additional Provision of the LOPDGDD 3/2018, the FUENGIROLA CITY COUNCIL has security measures established by its internal security regulations, following the National Security Framework (ENS) regulated by Royal Decree 311/2022 of May 3, 2022.
